Mother of Murdered Toddler Still Out On Bond, Trial Set for Feb.
Marco Gonzalez is planning a trip to south Texas next week.
He doesn’t celebrate Thanksgiving anymore, not since the death of his 3-year-old daughter, Jacqueline.
“We have my daughter’s ashes at my house,” Gonzalez told ABC-7. “Everyday we just look at it and ask ourselves why.”
Prosecutors maintain the toddler was abused to death by her mother, Yara Perez, and Perez’s then-boyfriend, Francisco Castaneda.
Castaneda was sentenced to life without parole early this year.
But three years after Jacqueline’s body was found stuffed inside the trunk of her mother’s car, Yara Perez remains out on bond.
Her capital murder trial was pushed back several times.
“People see her on the streets…happy and jolly,” Gonzalez said. “She has no sympathy at all.”
Gonzalez added Child Protective Services notified his family that Perez is once again pregnant.
Neither CPS nor Perez’s attorney could be reached to confirm or deny the claim.
Gonzalez also wonders why other high-profile murder cases, like that of David Marmolejo, have moved through the court system faster.
A spokeswoman for the El Paso District Attorney’s Office told ABC-7 Marmolejo’s trial was given priority because the suspect is currently incarcerated.
Perez’s case is being handled by the department’s ‘rape and child abuse’ unit made up of four prosecutors.
Those prosecutors have been busy, the spokeswoman added; most recently with the child abuse murder trial of Monea Tyson.
Tyson was found not guilty Thursday.
The District Attorney’s Office also told ABC-7 the department is just as anxious as Marco Gonzalez to move forward with Yara Perez’s case.
A trial date has been re-set for February 4th.
