Apodaca Arrested Over Failing To Comply With Court Order

Frank Apodaca, the former president of Access Healthsource who faces public corruption charges, was arrested earlier this week for allegedly failing to comply with a court-ordered doctor’s appointment, according to an FBI spokesperson.

In a recent interview with Apodaca and his wife Anita, Apodaca told ABC-7 he was not fit to stand trial right now because of a traumatic brain injury.

The FBI spokesman said Apodaca violated the conditions of his release by rescheduling an appointment with El Paso doctor David Briones without getting permission from the court.

Thursday night, Anita told ABC-7 her husband requested to reschedule his appointment but that since neither his attorney, assigned officer or Judge Frank Montalvo signed off on it, they headed back to El Paso from Houston to comply with that court-ordered appointment.

The Apodacas are in Houston where Frank Apodaca has been undergoing specialized treatment. Anita said her husband’s attorney warned them that the judge was probably not going to grant their request so they arrived in El Paso on March 11.

Frank Apodaca saw Briones the morning of March 13, as ordered, even though the doctor’s office had apparently cancelled the consult a few days before.

U.S. Marshalls showed up at their home that afternoon and arrested Frank Apodaca.He was released on Wednesday.

Frank Apodaca and others are accused of using bribes and kickbacks to get government contracts.
