or cold-blooded murder? tomorrow— the state and the defense will have one last chance to convince a jury on what really happened the night a santa fe deputy was shot and killed . tai chan is charged with first degree murder. he’s accused of killing his colleague jeremy martin at the hotel encanto in 2014 abc-7”s jamie warren has been following this trial for the past two weeks. she joins us live with more evan, it’s been a tense couple of weeks. we’ve heard emotional testimony from numerous witnesses. then on friday – chan, himself – took the stand giving his side og what happened the night of the killing. 30-39 “i knew if i didn’t have his gu i was going to die” tai chan wiping away tears on the witness stand recalling a deadly fight inside room 7-1 “i remember hearin banging on the door. open the door open the door” chan and martin wer staying the night in las cruces. they were supposed to head back to santa fe the next morning. but chan says after a night of drinking– an argument over a double homicide case pushed martin over the edge “he was like no one’s going to jail tonight. and i was like ok. defense attorney: ‘what did that mean to you?’ it was just weird like, i wasn’t thinking about anyone going to jail” chan says martin punched him repeatedly and hit him with his gun. he alleges martin threatened to shoot him. chan’s girlfriend was on the phone with him, listening to it all ‘your first thought was what? that tai was dead” chan says he got a hold of the gun. “chan i remember telling myself i have the gun, don’t let go of the gun.” and began firing at martin as the victim ran out of the room. “so i ran out the door and just started shooting. and i remember him running away and me thinking okay, i can stop shooting.” he said h was unaware he shot martin 5 times in the back. ” didn’t see i was hitting him i didn’t see he just kept running and i stopped” as for his behavior after the shooting “it’s bomb!” chan say no one was listening to him, and he wanted to get everyone’s attention – to warn everyone about a possible threat “i was saying sheriff’ office sheriff’s office to get someone to help me and no one was helping me” the prosecution says chan deliberately and willfully killed his colleague. when asked why chan didn’t call 9-1-1 before the problem escalated, chan said he didn’t want to get martin in trouble. this case will be handed over to a jury tomorrow. we will be there and continue to update you on air and online
