Document: Murder victim, alleged gunman knew each other from high school; ‘had a history’

Rogelio Franco Jr. and the man accused of shooting and killing him, Moises Galvan, knew each other from high school and had argued in the past, a complaint affidavit obtained by ABC-7 states.

Galvan and Franco got into a verbal argument near the patio area of Barfly, a bar located at 11335 Montwood in East El Paso, the night of January 29, 2017.

The court document states Franco walked out out of the bar and into the parking lot with David Ortega. They again encountered Galvan, who allegedly pulled out a small handgun and shot the men several times before running away, the affidavit states. A sheriff’s deputy and constable working as security guards at Barfly pursued and apprehended Galvan.

While running away, Galvan allegedly threw the handgun away, the affidavit states. The deputy and constable later found the weapon as they retraced Galvan’s steps.

Franco was pronounced dead at the crime scene. Paramedics rushed Ortega to a hospital.

Once at police headquarters, Galvan allegedly admitted to detectives he shot and killed Franco. When he was searched at police headquarters, Galvan was allegedly found to be in possession of marijuana.

Court documents state Ortega sustained gunshot wounds in three areas: left chest area, lower back, and his left hand.

Police charged Galvan with Murder, Aggravated Assault with a Deadly Weapon, and Possession of Marijuana.
