Las Cruces police warn public of pot laws ahead of 420 Festival

Las Cruces police will conduct frequent patrols of the 420 Festival at Young Park and are warning the public that possession of marijuana is prohibited.

In a news release, the Las Cruces Police Department reminds the public that the use and possession of marijuana is illegal in New Mexico except for those who carry a valid medical marijuana card from the state’s Department of Health. However, it is illegal for medical cannabis patients to possess or use marijuana in public.

The Department said it has had several meetings with the organizers of the festival and has been assured that adequate signage will be posted at the park to help ensure all New Mexico laws are followed.

Police provided information from the Medical Cannabis Program, which states in its rules and regulations portion that, “It is illegal to possess or use medical cannabis in a public vehicle, on school grounds or property, in the workplace of the patient or primary caregiver, or at a public park, recreation center, youth center or other public place.”

Police will patrol within the boundaries of the festival and outside, including the parking lots and surrounding neighborhoods. Residents are also reminded that it is illegal to operate a motor vehicle while under the influence of marijuana.

Only New Mexico residents can apply for the New Mexico Medical Cannabis Program.
