Man accused of giving boy loaded rifle before deadly shooting

Adrian Garcia, 36, was charged with criminal negligent homicide in connection to the deadly and accidental shooting of 10-year-old Kenneth Olivio, officials said.

Deputies responded to the shooting on the 19000 block of Highland in Tornillo at 4:30 pm on September 28 , 2017.

A ffidavits state that when sheriff’s officials entered the mobile home they found Olivio lying at the entrance of the master bedroom with a gunshot wound to his forehead.

Olivio and his mother, Lisete Reyes, were transported to the University Medical Center of El Paso where Olivio later died.

Garcia told the sheriff’s officials that he cleared the rifle, a semiautomatic caliber rifle, in the master bedroom by removing the rifle’s magazine, racking the rifle and seeing a bullet ejected, and racking the rifle several times. After that, Garcia said that he showed and handed the rifle to Reyes’ 11-year-old son who has not yet been identified. Sheriff’s officials say that is when the juvenile pulled the trigger causing it to fire and shoot Olivio as he walked into the bedroom.

The 11-year-old juvenile was also interviewed by sheriff’s officials and stated that he did see Garcia taking bullets out of the rifle. He said that when he asked Garcia if the rifle was loaded Garcia told him that it was not. He went on to tell sheriff’s officials that he pulled the trigger because he wanted to hear how it sounded. As he was pulling the trigger Olivio walked into the bedroom and was shot, according to sheriff’s officials.

The victim’s mother, Lisete Reyes, stated that her children were not familiar with firearms. She will not file criminal charges for her sons death.

Garcia stated that he has been living with Reyes and her sons for about three years but affidavits did not specify if Garcia is related to the victim.

The victim’s father, Ismael Olivio, believes that Garcia is the person responsible for the death of his son and is willing to file criminal charges.
