New Details: Intoxication assault charge filed after fiery I-10 crash

EL PASO, Texas (KVIA) -- ABC-7 has obtained court documents detailing what led up to Andres Rubio's arrest for intoxication assault with a vehicle causing severe bodily injury.

According to court documents, a witness told police officers that a white Ford Raptor entered I-10 East from the Raynolds Street entrance "at a high rate of speed." The truck swept across the lanes and almost hit the barrier, the witness told officers. The truck then swung all the way back over to the rightmost lane, rear-ending another car, the witness said. The witness said the truck then hit a barrier, drove off I-10, and came to rest on the 5600 block of Gateway East.

Court documents state that Rubio, the man in the car that was rear-ended, and Rubio's cousin were all rushed to the hospital after the collision. Court documents state that Rubio's cousin was in the front passenger seat at the time of the crash. Rubio's cousin told the police officers that they had just come from "coconuts" and had drunk alcohol. The cousin told police that he had fallen asleep and that the crash woke him back up. According to court documents, the cousin told investigators that Rubio was driving.

Court documents state that when investigators spoke with Rubio, he told them it was his wife who was driving at the time of the crash. Investigators noted in the court documents that no women were seen at the scene. According to the documents, Rubio told investigators that he was at Miami Bar and had three beers, a Ranch water, and alcohol from an unknown bottle in a thirty minute period more than eight hours before the collision. Investigators say that Rubio smelled like alcohol during the interview.


ORIGINAL STORY (December 26, 2025): The El Paso Police have arrested 31-year-old Andres Rubio for the fiery crash on I-10 East at Geronimo that sent three people to area hospitals.

The crash happened on Sunday, December 21 just after 8 p.m.

The El Paso Police report states, Rubio was driving a Ford F150 truck "at a high rate of speed" when he exited the Raynolds on ramp and tried to change lanes and hit the barrier.

Police investigators say Rubio then tried changing lanes again and rear-ended a Ford Explorer. The report states the truck then drove off the I-10 onto Gateway East, rolled over and caught fire.

The driver of the Explorer was taken to an area hospital with injuries to his lower back. Rubio and his passenger were also taken to the hospital. Rubio due to being unconscious and his passenger with an injured right hand.

The crash closed the eastbound lanes of I-10 in the area for several hours while the police conducted their investigation and TxDOT engineers assessed the damage to the overhead signage and removed the sign and debris from the roadway.

A TxDOT spokeswoman said a sign of similar size ranges between $250,000 to $350,000.

Rubio is facing a charge of intoxication assault with a vehicle causing severe bodily injury (SBI).

He was booked into the El Paso County Jail on Dec. 24 on a $75,000 surety bond. He posted bond the same day and was released.
