El Paso mother, out on bond, back behind bars

An El Paso mother, out on bond after being convicted in the death of her baby, is back behind bars.

Twenty-five year-old Lindsey Hradek had her bond revoked. In November she was granted a new trial and released, which the district attorney is appealing after she was convicted of reckless injury to a child in August and sentenced to 13 years in prison.

Apodaca Bail Bonds filed an affidavit earlier this month surrendering Hradek, stating that her mother, the co-signer for her $10,000 bond, requested to withdraw her as co-signer.

“I’m looking into what we’re going to do regarding issues of bond,” said Hradek’s attorney, Ruben Morales, who is still trying to figure out exactly why her bond was revoked. “We’re still looking into the various aspects as to what needs to be done, what’s going to happen.”

ABC-7 has video of Hradek crying with her mother after she was convicted. Last month, her mother told Apodaca Bail Bonds she was not complying with the conditions of her bond, stating she was not staying at home as the court ordered her to do.

According to El Paso Police, Hradek was arrested here at the La Quinta hotel located at I-10 and Geronimo on Christmas day. A source with access to records documenting events there told ABC-7 Hradek checked in late Christmas eve. At about 3:30 in the morning on Christmas day, a man showed up appearing to be under the influence of drugs. Police were called, they went to her room and that’s when she was arrested.

ABC-7 asked Morales what’s next for his client, who was granted a new trial, pending an appeal from the District Attorney.

“I raised various issues in my motion for a new trial … the state decided that it would appeal the judges order granting her a new trial … and so at this point everything is on hold until that appeal filed by the state gets determined by the court of appeals.”

ABC-7 also asked him whether Hradek will have to remain behind bars until a possible new trial.

“If a bond is set and she makes that bond then she will be out pending the appeal, pending the trial,” Morales said. “If she is not able to make that bond then of course she has to remain in jail.”

Hradek has already been granted a new bond hearing. It’s scheduled for Thursday at 11:30 a.m. in Judge Anna Perez’s court.
