Attorney: Store Destroyed Evidence In Fatal Crash

ALBUQUERQUE, N.M.(AP) – An attorney for a teenager who was the only survivor of an Interstate 25 crash last year is alleging a convenience store destroyed records showing it sold beer to the drunken driver who caused the crash.

Attorney Will Ferguson says Ever Ready Oil Company destroyed security camera tapes that would have shown that Dana Papst was already drunk when he was sold the beer at the Bernalillo convenience store.

Ferguson also alleges the store’s cash register receipts for that hour were destroyed when other receipts were printed on top of them. The owners of the store say they cannot comment because the case is in litigation.

Papst drove head-on into a Las Vegas family near Santa Fe last November 11th, killing five of them and himself. Authorities say his blood-alcohol content was four times the legal limit.
