Constable And County Employees Facing Lawsuit
ABC-7 has learned El Paso county and several current and former employees will soon face a civil lawsuit.
Many of them are former members of the precinct six constable’s office.
The abc seven I-team has uncovered this civil lawsuit filed in the federal court house Wednesday.
It details allegations of excessive force by former precinct six deputy constable Mario Ramos.
“”It’s wrong for somebody you think is there to protect and serve you to assault you in any way.”
ABC-Seven broke the story of suspected abuse at precinct six nearly a year ago, after Javier Montes showed us these pictures.
He claimed his brother, elderly father and his father’s elderly friend were pulled over by deputy constable mario ramos and beaten up .
“If he would have asked me to do anything, I would have done it. But everything he did, I think, was out of line.”
Since then, Ramos has been indicted for allegedly raping a woman and shooting a man – and was fired.
The three men allegedly beaten up by Ramos were charged with resisting arrest, assault and interference.
The district’s attorney’s office later dismissed the charges.
And now, the men are suing:the county of El Paso, former precinct six constable Alex Gamboa, former deputy constable Mario Ramos
and deputy constable Noe Juarez.
The lawsuit echoes what Ivan Montes told us last year – “He started beating on me constantly, bashing my head on the cement on the street.”
The suit says quote: ” Ramos then got on top of Ivan Montes on the pavement. Ramos began to kick Montes’s right arm violently as if trying to break it. “
It goes on to say:
“Guerrero Montes (Ivan’s father) went into shock. Ramos then raised Montes’s head up by grabbing his collar and then bashed his face repeatedly against the pavement.
…Ivan Montes eventually blacked out.”
THe lawsuit states, then 68 year-old Jesus Dominguez was thrown to the ground and handcuffed.
Quote: ” While ramos was arresting Dominguez, other constables who had arrived asked what Dominguez was going to be charged with since he did nothing wrong.
Ramos answered: “F***k it—-charge him with interference.”
The lawsuit also brings up prior complaints against Ramos.
Prior work problems of Ramos’s.
And prior issues with the constable precinct six office.
Quote: ” Defendants were grossly negligent and acted with malice and therefore are liable for punitive damages.”
Ramos has denied these allegations.
The suit is seeking 750 thousand dollars from all three men and the county.
And this may only be the first of many more suits.
Attorney Laura Enriquez says she has other clients with similar allegations and expects to file more lawsuits against the county and members of precinct six.
