Marmolejo Retrial: Defense Rests, Key Witness In 1st Trial Cries Outside Courtroom
The defense in the David Marmolejo murder case rested in the defendant’s retrial on Monday morning without calling a single witness.
David has been charged with murder in the July 2009 death of his mother, Gloria Marmolejo.
Closing arguments will begin Monday afternoon.
The prosecution rested on Saturday without calling Mariah Wilson, David’s stepsister and girlfriend at the time of Gloria’s death. In the first trial in the fall, it was Wilson who said on the stand that David admitted killing Gloria.
ABC-7 spotted in Wilson in the San Antonio courthouse hallway crying Monday morning.
Wilson testified in the first trial under full immunity, but because she did not testify in this trial the jury will not know she was given immunity.
Judge Gonzalo Garcia told the courtroom he is considering letting the jury go home after closing arguments so deliberations would begin Tuesday.
