Charges against Mayfield High School wrestling coach dismissed

Charges against a Mayfield High School wrestling coach were dismissed on Wednesday.

Third Judicial District Attorney Mark D’Antonio told ABC-7 there was a procedural error in the indictment.

D’Antonio said his office is still pursuing the case. He said they are discussing whether to pursue the case through another grand jury indictment or a preliminary hearing.

A Mayfield High School wrestling coach has been charged with criminal sexual contact of a minor.

A clerk at the Third Judicial District Court confirmed Jimmy Nevarez was charged with criminal sexual contact of a minor by school personnel, a fourth degree felony; intentional child abuse, a third degree felony; and harassment, a misdemeanor.

A grand jury handed down the indictment on Monday.

On Wednesday, Nevarez’s attorney Michael Stout filed a motion to dismiss the charges. Stout said he and the district attorney are stipulating that the indictment be dismissed.

Las Cruces Public Schools spokeswoman Jo Galvan confirmed Nevarez is the coach for the Mayfield High School varsity wrestling team and has been coaching for 15 years. He is set to be arraigned May 13 by District Judge Fernando Macias.

Galvan told ABC-7 the school district is aware of this issue, but they cannot speak on any personnel issues.

The superintendent has not determined if Nevarez will be allowed to coach next year. His contract expires at the end of each wrestling season.
