Judge tosses out key evidence in triple-fatal crash

joel garcia case. the judge has thrown out what could have been the most damaging evidence against him. the 24-year-old is facing three counts of intoxication manslaughter. police say garcia was under the influence when he crashed into another car on christmas eve, killing two brothers and one of their girlfriends. garcia has pleaded not guilty. the judge in the case made the decision, essentially saying police officers did not handle the case properly. abc-seven’s complete coverage now with reporter jerry najera. rick, abc-seven confirmed the judge threw out the blood sample taken from joel garcia that night… because it was taken without a warrant. earlier in the week… the judge heard from the three officers who arrested joel garcia. they testified how they got his confession and when his blood was drawn. the officers say it happened before they got the warrant because hospital staff was about to give garcia medication… which would have altered his blood chemistry. police say garcia was drunk and speeding when he smashed into a car killing three people … brothers — joshua and isaiah deal and joshua’s girlfriend shannon. the crash happened christmas eve morning at joe battle and vista del sol. isaiah and joshua deal’s family says there needs to be harsh consequences for dwi offenders. just listen to this 2014 interview from the deal brother’s stepfather. “the one thing we want is for people to understand how something so little can change so many lives” on top of the dismissal of the blood work… the judge also threw out part of garcia’s confession because he was read his miranda rights after he gave it to police. rick, back to you. tx-dot says the city of el paso could lose more than 21 million dollars in reimbursements
