Tai Chan, the former Santa Fe County sheriff’s deputy accused of killing his partner, is about to testify in his own defense.

Chan’s first trial ended in a mistral when the jury was unable to reach a verdict.

Chan is accused of killing fellow deputy Jeremy Martin inside the Hotel Encanto in Las Cruces in 2014.

The deputies were spending the night in Las Cruces after dropping off a prisoner in Arizona.

Witness testimony revealed the deputies had been drinking and arguing in the hours leading up to the deadly shooting.

Prosecutors say Chan shot Martin five times. The defense argues Chan shot Martin in self defense.
