Affidavit: Counselor raped boy during therapy session, threatened to kill him

An El Paso family counselor allegedly raped a boy under the age of 10 in his office during a therapy session and threatened to kill the boy if he said something, a criminal complaint obtained by ABC-7 states.

Jose Martinez III, 55, was arrested by the Crimes Against Children detectives the morning of October 26, 2018 on two warrants for aggravated sexual assault of a child. Police said Martinez is a family counselor at Martinez Joe E LPC-NCC Counseling, located at 4171 N. Mesa #A106.

The accuser told police Martinez raped him during a therapy session in December 2017. During the session, Martinez asked the boy to go over to his desk, where he could play with Legos. While the boy was playing, Martinez allegedly pulled down his pants, exposing his penis, the criminal complaint states.

The boy told his mother and police Martinez then pulled down the boy’s pants and started touching the boy’s “private parts.” Martinez allegedly stood up, got behind the boy and raped him, the criminal complaint states.

The accuser told police he turned back while he was being raped and it appeared Martinez was recording the rape with his cell phone.

Martinez allegedly told the boy he would kill him if he told anyone, the criminal complaint states.

Martinez was booked into the El Paso County Detention Facility with bonds totaling $200,000.

Crimes Against Children detectives are asking any current or former patients that may have been a victim or may have related information about Martinez to contact them at (915) 212-0382.
