Otero County man convicted of 5th DWI, facing up to 3 years in prison
It took a jury in Otero County less than an hour to convict a man on a fifth DWI-related offense and he is now facing up to three years in prison.
The jury found 53-year-old Faustino Holguin guilty of “Driving While Under the Influence of Intoxicating Liquor” and “Driving While License Revoked.”
On May 15, 2016, a deputy with the Otero County Sheriff’s Office was dispatched to the intersection of Luna Drive and Angelina Boulevard in Chaparral after an anonymous caller reported a possible drunk driver.
When the deputies arrived, they noticed a red Dodge Stratus stopped in the middle of the roadway.
The deputies said Holguin was standing outside of the vehicle stumbling around without a shirt.
One of the deputies approached Holguin and asked him if he was okay. While he was speaking to Holguin, the deputy observed Holguin had blood shot, watery eyes and smelled very strongly of alcohol.
The deputy also noticed Holguin’s pants zipper was open and there was “large, fresh wet spot on the roadway.”
Holguin later admitted to deputies he had been drinking and had driven to that location.
The deputy asked Holguin if he would agree to perform field sobriety tests, but Holguin refused and said “no, because I’m too drunk to do your tests.” Holguin begged the deputy not to take him to jail, saying “I know I’m drunk and shouldn’t drive.”
Investigators said Holguin’s blood alcohol content was .34, more than four times the legal limit.
Holguin’s license had previously been revoked for a prior DWI Offense.
Holguin was taken into the custody of the Otero County Detention Center pending sentencing, which is expected to occur later this year. He faces up to 3 years in prison.
