Lawyer of El Paso woman whose 3-year-old drowned at a city water park responds to criminal charge
EL PASO, Texas (KVIA) -- Jessica Weaver, the mother of the 3-year-old who died at Camp Cohen Water Park in May, is now charged with of Injury to a Child by Omission.
Weaver had filed a lawsuit against Destination El Paso and the company that runs the Camp Cohen Water Park, ASM Global, in July. Weaver's attorney for that suit, Ryan MacLeod, sent out a statement Wednesday morning in response to the new charge.
"Rather than send El Paso law enforcement to Indiana to transport Ms. Weaver back to El Paso or allow Ms. Weaver’s counsel to arrange for her return to El Paso, District Attorney Bill Hicks decided to pull a political stunt and hold a press conference to announce that Ms. Weaver was being charged with intentionally or knowingly causing serious bodily injury to her only child," MacLeod told ABC-7 in the statement.
On Tuesday, District Attorney Bill Hicks held a news conference to discuss the charges filed against Weaver. In that update, Hicks outlined El Paso Police's efforts to organize Weaver's transport back to El Paso.
MacLeod ended his response by inviting El Paso's District Attorney to upcoming depositions in the civil lawsuit Weaver filed, that are set for September 28th.
ABC-7 is working to get official responses filed by the City of El Paso and other defendants in response to the lawsuit. We are also working to learn how the new criminal charge could impact the civil lawsuit.
