Affidavit: Coach paid for teen’s nipple piercings, requested photos

Investigators arrested a 26-year-old soccer coach and charged him with “Contributing to the Delinquency of a Minor” after he allegedly took a high school student to get her nipples pierced.

Court documents obtained by ABC-7’s New Mexico Mobile Newsroom state Victor Gutierrez is an independent club soccer coach as well as a former coach with the Mayfield High School boys’ soccer team.

Investigators learned Gutierrez and the 16-year-old girl often communicated through social media and while on the soccer field. Documents state the girl and Gutierrez would talk about personal issues.

Other girls on the soccer team, documents state, allegedly told the 16-year-old, “if you wanted a piercing get with Coach Victor, he would take you.”

Investigators learned that on Jan. 17, 2017, the girl missed a portion of a class at school and was marked absent. The school notified the girl’s mother, who questioned her daughter and learned Gutierrez had taken her to a local tattoo shop where she received the piercings.

After the girl and Gutierrez left the piercing shop, they went to eat lunch at Peter Piper Pizza before Gutierrez dropped the girl back off at school, the documents state.

The affidavit further states Gutierrez asked the girl to send him photos of the piercings. The document does not reveal if the girl sent Gutierrez the picture.

New Mexico State Statute pertaining to tattooing and piercings states minors must have a parent or legal guardian present and written consent must be provided to receive services. Detectives learned Gutierrez, who is not related to the girl, facilitated the acts to enable the 16-year-old to be pierced without her parents’ consent or knowledge.

The 16-year-old allegedly told detectives she was unaware of any consent/authorization paperwork that was filled out while they were at the shop. The girl further stated Gutierrez paid for the piercings, documents state.

Detectives learned Gutierrez may have taken other underage girls for piercings as well. Anyone with information on other similar incidents is asked to call police at (575) 526-0795.

According to the Las Cruces Public School District, Gutierrez’s contract had expired when the accusations came to light. The district says he will not be re-hired.

Gutierrez was arrested March 3 and was released the same day on a $10,000 cash bond.
